Please read the following Terms and Conditions ("T&Cs") carefully.
These T&Cs govern the use of the MedicalTopJobs® career portal, provided by Media Consult Maier + Partner GmbH, Karlsruhe.
If you do not agree to these T&Cs, you will not be able to use MedicalTopJobs® or the services offered on the platform.

1. Advertisement Contract - Scope
The term “advertisement contract” as used in these General Terms and Conditions refers to the contract for the placement of one or more advertisements by a job provider or other interested parties (client, advertisement intermediaries) on the job market MedicalTopJobs or any other job portal requested by the client for dissemination purposes. These General Terms and Conditions apply exclusively to the advertisement contract; conflicting or deviating terms of the client shall not become part of the contract unless we have expressly agreed to their validity in writing.
2. Conclusion of the Contract
The advertisement contract is concluded when:
a) we confirm the advertisement order in writing, and
b) we distribute a job advertisement on our partner portals and social media channels as part of the advertisement order on the internet.
Written form is maintained by sending an email.
3. Right of Refusal
We reserve the right to reject advertisement orders based on their content, origin, or technical form, according to consistent, objectively justified principles. This applies particularly if the content of the job advertisement violates legal regulations, especially the General Equal Treatment Act (AGG), or other governmental prohibitions, or is contrary to good morals, or if its publication is otherwise unreasonable for us. We are entitled to remove job advertisements and other advertisements whose content violates legal or governmental prohibitions or good morals without prior warning to the client. The client will be informed of such measures immediately. This does not entitle the client to a refund.
4. Content and Rights to the Advertisement / Copyright
The client is solely responsible for the content, especially the accuracy and legality, of the text and image materials provided for the publication of the advertisements. We are not obliged to review the advertisement for infringements of third-party rights. The client is obliged to indemnify us from third-party claims that may arise against us in any way from the execution of the advertisement order. If protected trademark rights are used in the advertisement, the client grants us permission to use these rights by placing the order. The client assures that they are authorized to grant such permission. We acquire exclusive copyrights and/or other related rights to all job advertisements we create and publish. The payment of the fee by the client, including for the creation of the HTML layout, does not transfer copyright and/or related rights to the client or the agency acting on their behalf, unless otherwise agreed in writing. If the job advertisement published by us was created by the client or an agency acting on their behalf (including the HTML source code), the client grants us the exclusive right to use the job advertisement in all usage types related to its publication on our sites or partner portals. Section 2, sentence 2 applies accordingly. In particular, we are also authorized to defend against unlawful infringements of copyright by third parties in connection with the publication and to assert resulting claims for damages. All information published by us (texts, images, etc.) is subject to our copyright. Excluded from this are information published by us, whose creation (including the HTML source code) was carried out by the client or an agency acting on their behalf. In these cases, the copyright lies with the respective client or their agency. Section 2 and Section 3, sentence 3 apply accordingly.
5. Start of Publication and Duration
The start of publication takes place at the time agreed in writing with the client. If no such time is agreed, publication of the job advertisement generally occurs 24 hours after receipt of the order and immediate approval of the correction link. The client is responsible for the complete delivery of flawless, suitable data. Delays due to technical or content-related problems with the data delivered by the client are generally not our responsibility. Unless otherwise agreed in writing or the advertisement is canceled due to the filling of the position, the standard runtime is 6 weeks.
6. Fees, Default
The client pays us for the placement of their advertisements, subject to other written agreements or deviations as part of special promotions, the fee stated and selected in the order form. The applicable price is the one specified in the order form at the time of the client's order. We will invoice the client immediately after the placement of the advertisement. Payment is due without deductions within 7 days of receipt of the invoice. We reserve the right to only process orders from new clients against prepayment. We grant agencies a 10% discount on paid advertisement placements unless otherwise agreed in writing. We reserve the right to verify the agency's entitlement to AE remuneration on a case-by-case basis. If we can prove that the delay in payment causes greater damage than the statutory interest rate, we are entitled to claim this. The client is only entitled to offsetting if and to the extent that the counterclaim has been legally established. If the client is in default with payment, we are entitled to temporarily suspend the contractual obligation to execute orders and access to our free services until all due invoices have been paid. Furthermore, we are free to require prepayment for subsequent orders.
7. Place of Publication, Linking / Framing
The fee paid by the client is for the publication of a job advertisement on MedicalTopJobs as well as for publication on the platforms selected in the booking order and in print or other media chosen by individual order. Our liability for the proper execution of advertisement orders is limited to the flawless and timely transmission of the print materials or data. For all further technical guarantees, the respective commissioned publisher/portal is responsible in accordance with its terms and conditions. Therefore, the client is entitled to publication during the contract term under sentence 1. The client declares by agreeing to these AGB, unless otherwise notified, that they expressly wish their job advertisements to be published by us. This ensures that only up-to-date job advertisements are always published. In this context, the client is advised that, given current technology, it cannot be entirely excluded that the job advertisements published on our online pages may also be copied, linked, and/or additionally published by other online providers and meta-job search engines using frames, disguised as their own offer. We will strive to prevent copying, linking, and/or framing as described above within the technical and legal possibilities. To this end, the client already grants us all necessary approvals. However, should unauthorized linking and/or framing occur, the client cannot derive any claims against us from this.
8. Changes to the Advertisement Text
We are obliged to make changes to the job advertisement distributed by us at the request of the client during the publication period, provided this is technically and content-wise reasonable. Excluded are changes that affect the identity of the advertisement and the original job title, so that a new position would be advertised in case of the change. Changes that can be made with minimal effort will be carried out free of charge. If this is not the case, we will inform the client and, after receiving written or email confirmation, make the requested change to the job advertisement at an additional cost based on the effort involved.
9. Warranty
We guarantee a technically standard, best possible reproduction of the job advertisement based on the supplied data (logos, images) and the provided links, e.g., to the internal applicant database. A display error in the job advertisement does not exist, particularly if caused by the use of unsuitable display software and/or hardware (e.g., browsers) or by disruption of communication networks of other operators, server failure at an internet access provider or online service, or incomplete and/or outdated content on so-called proxy servers (caching) of commercial and non-commercial providers and online services, or server downtime not exceeding 24 hours (continuous or cumulative) within 30 days of the agreed start of the contract. In cases described in paragraph 2, the client is entitled to an extension of the advertisement's placement for the duration of the downtime. In the event of a defective display of the job advertisement for which we are responsible, the client is entitled to a flawless replacement advertisement, but only to the extent that the purpose of the job advertisement was impaired. If we are unwilling or unable to do so, or if a replacement advertisement fails for reasons we are responsible for, the client is entitled to withdraw from the contract (withdrawal) or demand a reduction in the advertisement price (reduction).
10. Complaints
In the case of business transactions between merchants, the client must immediately inspect the placed advertisement after the first publication and report any defects without delay. The period for complaints in such business transactions begins with the publication of the advertisement for open defects, or upon discovery for hidden defects. If the client fails to report the defect, the advertisement is considered approved without defects.
11. Storage of Materials - Archiving of Advertisements
Image material or data carriers provided by the client will only be returned upon written request. The obligation to store such materials ends three months after the conclusion of the advertisement contract. All advertisements placed are archived for at least one year after the placement period and can be reactivated at any time. However, we are not obliged to store the advertisement after the contract has ended.
12. Jurisdiction is Karlsruhe

These T&Cs govern the use of the MedicalTalentNetwork, provided by Media Consult Maier + Partner GmbH, Karlsruhe.
If you do not agree to these T&Cs, you will not be able to use MedicalTalentNetwork or the services offered on the platform.

1. Subject of the Membership
With a basic membership in the MedicalTalentNetwork, Media Consult Maier + Partner GmbH – hereinafter referred to as MCM – allows the mirroring of all job offers from a provider on the MedicalTopJobs® platform for a fixed price. This membership can be booked either on a monthly basis or for an entire year.
2. Termination and Duration
- Monthly booking: The membership can be cancelled at any time at the end of the following month.
- Annual booking: The membership will automatically expire at the end of the year. Prior to expiry, the customer will be contacted by MCM to discuss the option of renewal.
3. Responsibility and Liability
MCM does not interfere with the structures or data of the job provider. The job advertisements are displayed in the mobile-friendly tile format that is standard on MedicalTopJobs®.

5. MCM accepts no responsibility for the accuracy or timeliness of the information in the mirrored job advertisements. This responsibility lies solely with the job provider.
6. Data Protection
MCM is obligated to ensure that no data from applicants is collected during the mirroring process. All applicant data is handled exclusively through the provider’s Applicant Tracking System (ATS). MCM does not process any personal data from applicants.
7. Exclusion of Guarantee for Duration
The typical duration for job advertisements on MedicalTopJobs® is 6 weeks to ensure an up-to-date offering for applicants. Since the advertisements are updated daily, ads that remain active on the provider’s career portal for more than 6 weeks may also be included. MCM guarantees daily updates but does not guarantee the timeliness of the mirrored advertisements.
8. Exclusion of Obligation
MCM is not obligated to mirror job offers, particularly if the job titles offered do not align with the usual job offers in the healthcare sector or if, in MCM’s view, the content is harmful.

These T&Cs govern the use of the medi.career WebApp, provided by Media Consult Maier + Partner GmbH, Karlsruhe.
If you do not agree to these T&Cs, you will not be able to use medi.career WebApp or the services offered on the platform.

1. Introduction Please read the following General Terms and Conditions ("AGB") carefully.
These AGB govern the use of the medi.career WebApp provided by Media Consult Maier + Partner GmbH, Karlsruhe.
If you do not agree with these AGB, the medi.career WebApp and the services offered cannot be used.
These AGB are valid from 01.01.2016.
2. Binding Contractual Relationship
These AGB (which Media Consult Maier + Partner GmbH may modify) form a binding part of the contract between you and Media Consult Maier + Partner GmbH. Upon registration with medi.career, you will be asked to confirm your agreement to these AGB. Media Consult Maier + Partner GmbH may modify these AGB at any time, such as through an update to medi.career (e.g., for added features). After any changes to the AGB, the user will be required to accept the updated terms before logging in again. If you do not agree to the changes, you will no longer be eligible to use the service.
3. Subject of the Contract
The contract includes the submission of questions related to a specific job offer, either via a link or QR code, which must be answered truthfully and an email contact provided, through which potential employers can reach you. The medi.career WebApp is intended for initial contact between you and the job offer provider. The job provider is under no obligation to contact you. By submitting your completed questions and contact details, you agree that employees of the job provider may contact you via the email address or phone number you have provided.
4. Responsibility
You agree to use medi.career responsibly. You confirm that you will provide information and contact details only for yourself and not on behalf of a third party. Furthermore, you agree that your contact details will be passed on to the job provider and, upon their review, fall under the job provider's data protection regulations.
4.1 General Rules of Use
medi.career is intended for individuals either seeking employment or for employers or HR managers looking to recruit suitable candidates for open positions.
By using medi.career, you agree that:
(a) you will not use medi.career to (i) support or engage in criminal activities, (ii) violate any applicable laws, (iii) take actions that cause liability for Media Consult Maier + Partner GmbH towards third parties;
(b) you will use medi.career solely for personal purposes and not otherwise;
(c) you will not use medi.career to distribute content via email, questionnaires, or other means that is defamatory, obscene, infringes copyright, vulgar, or otherwise offensive or derogatory, particularly concerning other individuals or groups based on religion, gender, sexual orientation, ethnic origin, age, or disability;
(d) you will not use programs, tools, or software that attempt to access or interfere with medi.career or its services through manual or automatic software, devices, or processes (e.g., browsers, spiders, robots, avatars, or intelligent agents), except for search engines and search tools that Media Consult Maier + Partner GmbH generally provides or permits (e.g., Internet Explorer, Firefox, Safari);
(e) you will not use medi.career to advertise your products or those of third parties, including via "spam" emails;
(f) you will not attempt to disrupt or block other users' access to medi.career, including spreading viruses, trojans, or other harmful programs;
(g) you will not access or attempt to access other users' accounts or override the security measures of medi.career.
4.2 Intellectual Property Rights
All materials contained on the medi.career site and all other rights related to the operation of medi.career are the exclusive property of Media Consult Maier + Partner GmbH and are protected by European copyright and trademark law. Except for the limited licences granted to you under these terms and conditions, all rights are retained by Media Consult Maier + Partner GmbH.
You may not reproduce, modify, display, sell, or otherwise use the content or materials from medi.career for commercial purposes. These restrictions include, in particular:
(a) copying or modifying the code/scripts used to generate the medi.career website; and
(b) collecting, copying, or reproducing information available on medi.career without prior written consent from Media Consult Maier + Partner GmbH.
The use of medi.career content on another website or networked computer for any other purpose is prohibited. "medi.career", the medi.career design logo, and all other names or logos are service marks or trademarks of Media Consult Maier + Partner GmbH. All products, service names, design marks, and slogans are also trademarks of Media Consult Maier + Partner GmbH. Additionally, the "look and feel" of medi.career, including its colour schemes, button shapes, layout, design, and all other graphic elements, are protected by Media Consult Maier + Partner GmbH’s rights or the rights of the relevant licensor in trademarks, service marks, or copyrights. The code/scripts used by Media Consult Maier + Partner GmbH to generate or display the content of medi.career are also protected by Media Consult Maier + Partner GmbH’s copyright.
In the case of authorised reproduction of content or materials from medi.career, all copyrights, trademarks, service marks, and other proprietary notices must be retained.
All other products and service marks on medi.career are trademarks of their respective owners.
4.3 Usage Licence for Job Seekers
Media Consult Maier + Partner GmbH grants job seekers a limited, revocable, and non-exclusive right to use medi.career for personal purposes to search for employment opportunities. This entitles you to view and download the materials posted on medi.career, but only for your personal use and not for commercial purposes.
You are solely responsible for the documents you upload and their content, and you understand the potential consequences of uploading such documents or content. Users have no legal entitlement to use the site.
Media Consult Maier + Partner GmbH may suspend your access to medi.career if it is necessary to protect the interests of Media Consult Maier + Partner GmbH or other users, if:
(a) Media Consult Maier + Partner GmbH has previously set a reasonable deadline which has passed without resolution, or
(b) there is a significant reason, such as a violation of Section 4.1 or Section 12 of these terms and conditions.
Additionally, Media Consult Maier + Partner GmbH may terminate access at any time with one month’s notice.
4.4 Additional User Rules
The user guarantees that:
(a) They are at least 16 years old, and if they are under 18 or not yet of legal age according to applicable law, they will only use the site under the supervision of a parent, legal guardian, or authorised custodian; and
(b) They will not use medi.career for purposes other than those allowed (or encourage others to do so or assist them in doing so), as prohibited by these terms and conditions or applicable law. You are responsible for ensuring that your use of medi.career complies with these terms and all applicable regulations.
4.5 User Submissions
Media Consult Maier + Partner GmbH welcomes user suggestions regarding the services offered on medi.career. However, Media Consult Maier + Partner GmbH does not accept creative ideas, suggestions, inventions, or other materials ("User Submissions") unless they have been expressly requested.
If you do submit any suggestions, please ensure they are clearly formulated. If, contrary to this notice, you still submit User Submissions to Media Consult Maier + Partner GmbH, please be aware that any such User Submissions, to the extent that they are not protected by copyright, trademark, related rights, or similar protections, will become the property of Media Consult Maier + Partner GmbH. Media Consult Maier + Partner GmbH is under no obligation to store User Submissions. Submissions and all content therein do not create a duty of confidentiality for Media Consult Maier + Partner GmbH. Media Consult Maier + Partner GmbH is also not responsible for any uses or publications of User Submissions by third parties.
5. Disclaimer of Liability
5.1 Responsibility
Media Consult Maier + Partner GmbH is not responsible for the documents and content uploaded by users on medi.career, nor for any actions, omissions, or other conduct by users.
Medi.career serves solely as an online platform for the distribution and publication of information uploaded by users, and Media Consult Maier + Partner GmbH is not obligated to review or pre-screen the information uploaded by users or the communication between users. Media Consult Maier + Partner GmbH is also not responsible for any monitoring tools that a user may have installed.
If a user informs Media Consult Maier + Partner GmbH that a document may violate these terms and conditions, Media Consult Maier + Partner GmbH may take further action to determine if a violation has occurred and may remove the document at its own discretion or request its removal. Media Consult Maier + Partner GmbH is not liable for such violations by the user. However, Media Consult Maier + Partner GmbH may take any necessary and appropriate action at its discretion concerning the information posted by users.
5.2 No Endorsement of User Information
No information published on medi.career regarding a user or any third party constitutes an endorsement or warranty by Media Consult Maier + Partner GmbH concerning their websites, products, services, potential employment, stated experience, employment or hiring practices, or in any other way.
5.3 No Warranties
(a) Media Consult Maier + Partner GmbH provides no warranties for the content on medi.career. In particular, Media Consult Maier + Partner GmbH does not guarantee that third-party rights are not infringed. Furthermore, Media Consult Maier + Partner GmbH provides no warranty regarding the accuracy, error-free functionality, usability, completeness, or timeliness of medi.career.
(b) Subject to the foregoing:
(i) Media Consult Maier + Partner GmbH does not warrant that medi.career will operate without errors or that the servers used are free from computer viruses or other harmful software. Should the use of medi.career result in damage to your computer or software, Media Consult Maier + Partner GmbH shall not be liable for any repair costs.
(ii) Media Consult Maier + Partner GmbH offers no guarantee for the accuracy, truthfulness, legality, completeness, timeliness, or reliability of information uploaded by users or any form of communication involving a user. Documents may contain inaccuracies or typographical errors. Any reliance on documents uploaded by users or any form of communication involving a user is at your own risk.
(iii) Media Consult Maier + Partner GmbH does not guarantee that the services provided on medi.career will achieve the employment goals desired by the user. Media Consult Maier + Partner GmbH does not warrant that its services will result in the hiring of a suitable candidate or the filling of a vacant position. Media Consult Maier + Partner GmbH is not responsible for any business decisions made by the user regarding the employment of a candidate or any salary decisions.
5.4 Limitation of Liability
Media Consult Maier + Partner GmbH and its agents are not liable for slight negligence in connection with medi.career, regardless of the legal basis. This limitation of liability does not apply where a duty on which the user regularly relies (“cardinal duty”) has been breached or in cases where a warranty has been provided or where injury to life, body, or health has occurred. In such cases, liability is limited to the foreseeable damage at the time of contract conclusion. In all other cases, liability is limited to the amount paid by the user or, if no payment was made, to €150, unless the user can prove that the actual damage was significantly higher.
5.5 User Identity
As verifying identity on the internet is difficult, Media Consult Maier + Partner GmbH cannot and will not confirm or verify the identity of any user as claimed. As Media Consult Maier + Partner GmbH is not involved in communication between users and does not monitor their behaviour, each user acts independently, and Media Consult Maier + Partner GmbH is not liable for any resulting damages.
6. Links to Other Websites
medi.career contains links to other websites. These links are provided for informational purposes only and do not constitute an endorsement by Media Consult Maier + Partner GmbH of the content contained therein. Media Consult Maier + Partner GmbH is not responsible for the content of third-party websites and makes no guarantees as to the accuracy of the materials provided on these sites. Visiting these websites is at your own risk.
7. Exclusive Application of These Terms and Conditions
Any terms or conditions submitted by the user that deviate from these terms and conditions are deemed rejected by Media Consult Maier + Partner GmbH, unless Media Consult Maier + Partner GmbH has explicitly accepted them in writing.
8. Indemnification
The user agrees to indemnify Media Consult Maier + Partner GmbH (as well as its board members, officers, shareholders, employees, subsidiaries, affiliates, agents, or advertisers) against all claims for damages, lawsuits, or demands from third parties (including, without limitation, all costs, damages, and reasonable auditing and legal fees) arising from the user’s use of medi.career; from documents uploaded by the user to medi.career; from the user’s use of the services; or from the user’s violation of these terms and conditions or the contract.
Media Consult Maier + Partner GmbH is obligated to inform the user of any such claims, lawsuits, or proceedings and to support the user, at their expense, in defending against such claims, lawsuits, or proceedings.
9. User Information and Data Protection Provisions
9.1 When registering with medi.career, the user must create a user profile by providing Media Consult Maier + Partner GmbH with a valid email address ("User Information"). By registering, the user assigns all ownership rights related to the user profile to Media Consult Maier + Partner GmbH (this does not apply to personal data uploaded by the user).
9.2 Users are required to review Media Consult Maier + Partner GmbH's privacy policy (available at www.medicaltopjobs.de/datenschutz), which provides important information regarding the use of your personal data, as well as details on the data protection and security processes and related policies.
All user information will be used exclusively in accordance with the provisions of Media Consult Maier + Partner GmbH's privacy policy. Under this privacy policy, Media Consult Maier + Partner GmbH may collect certain user information and contact the user periodically.
Additionally, Media Consult Maier + Partner GmbH is entitled, at its discretion, to disclose certain user information if necessary to comply with legal requirements, investigation requests from law enforcement authorities, or other government bodies. Third parties are also permitted to store copies of user information ("Cache Copies") if the user has provided this information to them.
10. Questions and Comments
Any questions regarding the use of medi.career should be directed to Media Consult Maier + Partner GmbH via the "Contact" section. Any comments addressed to Media Consult Maier + Partner GmbH should also be submitted through the contact form accessible via medi.career.
11. General Provisions
The contact address for Media Consult Maier + Partner GmbH is provided on medi.career. Media Consult Maier + Partner GmbH does not guarantee that the content is suitable for the user’s intended use outside Germany or that it will be available for download. For certain individuals or in some countries, access to the information on medi.career may be legally restricted, and no right to access medi.career is granted in such cases.
Access to medi.career outside of Germany is at the user’s own risk, and the user is responsible for ensuring that such use complies with the applicable local laws. The contractual relationship between the parties is governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive jurisdiction for any disputes with employers arising in connection with these terms and conditions or the Service Activation Agreement (if such exists) is Frankfurt am Main. The exclusive business relationship between you and Media Consult Maier + Partner GmbH is between independent parties. Should any provision of this contract be declared invalid by a competent court, the validity of the remaining provisions of this contract shall not be affected and shall remain binding.
All provisions of this contract shall remain in effect in the event of termination, except for those governing access to and use of medi.career. Upon termination, the right to use medi.career shall be revoked with immediate effect.
The user is not permitted to assign or transfer the contract or any individual obligations arising from it without prior written consent from Media Consult Maier + Partner GmbH. This contract constitutes the sole contractual basis for the relationship between the user and Media Consult Maier + Partner GmbH, unless Media Consult Maier + Partner GmbH expressly declares otherwise in a "Legal Notice" or in the materials provided on medi.career.
12. Provisions for Uploading Information, Operation, and Security
The following provisions apply to the use of medi.career and/or the use of its services. This list is not an exhaustive representation of the user regulations.
12.1 Provisions for Uploading Information
By using medi.career, the user agrees to comply with the following guidelines when uploading documents:
(a) Users are prohibited from uploading documents to medi.career that:
(i) contain URLs or links to other websites (for more information on advertising your company or website, please refer to the “Advertising Info page”);
(ii) include copyrighted material (unless the user owns the copyright or the copyright holder has granted permission for its use);
(iii) disclose trade secrets (unless the user owns the trade secrets or has permission from the trade secret holder to disclose them);
(iv) infringe intellectual property rights or other third-party rights;
(v) contain keywords or hidden keywords (“white text keywords”) (such as words embedded in the text in a manner not visible to users);
(vi) include statements that are discriminatory, sexually explicit, obscene, offensive, defamatory, threatening, harassing, or otherwise inappropriate; or
(vii) contain statements intended to insult other individuals or companies.
(b) Users are prohibited from using a document to:
(i) impersonate another person (whether alive or deceased);
(ii) disseminate false, inaccurate, or misleading information, opinions, or communications (commercial or otherwise) or chain letters; or
(iii) distribute advertisements or solicit clients (including unsolicited commercial emails, pyramid schemes, or other membership-based solicitations). However, Media Consult Maier + Partner GmbH reserves the right to allow certain offers against payment, a commission, or regular fees, and to place such offers on medi.career at its discretion. If Media Consult Maier + Partner GmbH deems these offers misleading or inadequate, they may be removed entirely to protect users.
(c) User-uploaded documents must be sufficiently detailed and descriptive to accurately reflect the job offer and its requirements. This also applies when the user is seeking a position. In this case, the user must provide a detailed and accurate description of their qualifications. Users are prohibited from asking others to request further information (e.g., by stating that more details will be provided upon request). Uploading third-party documents that require payment for use or that impair access to information already provided in CVs is not permitted.
(d) The information uploaded in a short interview must provide accurate details about a living person who is seeking full-time employment, part-time work, or freelance opportunities.
(e) Media Consult Maier + Partner GmbH is under no obligation to systematically review information uploaded to medi.career, although it may conduct spot checks. Media Consult Maier + Partner GmbH reserves the right to remove content that violates these provisions at its discretion.
(f) Users are prohibited from uploading sensitive information, as defined by the German Federal Data Protection Act, regarding their ethnic origin, political opinions, religious or philosophical beliefs, union membership, health, or sexual orientation (“special categories of personal data”). Media Consult Maier + Partner GmbH is not liable if a user nevertheless submits special categories of personal data.
12.2 Behavioural Guidelines
(a) Users should only contact each other when searching for a position or a suitable candidate for a job (for example, applying for an open position or having further discussions with potential candidates). Any communication designed to promote a user’s business beyond this context is prohibited.
(b) Sending unsolicited commercial emails is prohibited.
(c) Password protection. Users are responsible for maintaining the confidentiality of their data and password. Users are responsible for all – authorised or unauthorised – registrations on medi.career. If a third party unlawfully uses a user's password, the user’s access to medi.career may be suspended to protect other users. In the event of unauthorised use of the user’s password and account, the user must notify Media Consult Maier + Partner GmbH immediately.
(d) Any inappropriate behaviour should be reported using the "Feedback" section.
(e) Users are not permitted to delete or modify information uploaded by another user.
(f) If Media Consult Maier + Partner GmbH becomes aware that a user:
(i) has misrepresented their business practices and/or the services they offer, or
(ii) has provided false information about their business activities or an open position,
Media Consult Maier + Partner GmbH reserves the right to terminate the contract without notice.
12.3 Security Provisions
(a) Users must not compromise the security of medi.career, particularly by:
(i) accessing data that has not been authorised for them or attempting to log into an account they are not permitted to access;
(ii) testing, scanning, or probing the medi.career networks or systems for vulnerabilities or weaknesses, or attempting to circumvent security or authentication measures;
(iii) disrupting or attempting to disrupt the network or connection to another user, including by uploading viruses, overloading the network with large amounts of data, or sending excessive emails (“overloading”, "flooding", "mailbombing", or "crashing");
(iv) sending unsolicited emails, especially to advertise products or services; or
(v) falsifying TCP/IP packet headers or any part of the header information in emails.
(b) Violations of these security provisions may result in civil and/or criminal liability. Media Consult Maier + Partner GmbH will investigate incidents that constitute security breaches and pursue appropriate legal action, including bringing charges with the help of law enforcement authorities and enforcing civil claims.
13. Copyright Complaints
13.1 Media Consult Maier + Partner GmbH respects the intellectual property rights of others. Media Consult Maier + Partner GmbH acknowledges copyrights and intellectual property and will act on any claimed infringements of these rights. Media Consult Maier + Partner GmbH will promptly investigate reported violations and take appropriate action in accordance with the Digital Millennium Copyright Act (DMCA) or other applicable laws for the protection of intellectual property or e-commerce laws. Upon receiving a notice under the DMCA or other similar laws, Media Consult Maier + Partner GmbH will promptly remove the material in question or disable access to it, or prevent any related links. In the event of repeated infringements of intellectual property laws by a user, Media Consult Maier + Partner GmbH reserves the right to terminate the contract without notice.
13.2 Reporting a Copyright Infringement
To report a copyright infringement, please submit a written notice using the contact form available via the "Contact" link on the medi.career homepage, which contains the relevant contact details. Please be aware that if you wrongly accuse someone of copyright infringement, you may be held liable for damages.
13.3 Submitting Counter-Notices to Media Consult Maier + Partner GmbH
If Media Consult Maier + Partner GmbH suspends access to a user profile on medi.career due to a copyright complaint, Media Consult Maier + Partner GmbH will make reasonable efforts to contact the user or the administrator of the medi.career page. If the affected party believes that the materials in question do not violate copyright laws, they may contact Media Consult Maier + Partner GmbH via the “Contact” link on the medi.career homepage to submit a written counter-notice. Please note that if you falsely claim that there has been no copyright violation, you may be held liable for damages (including legal and attorney fees). If you are unsure whether your activity constitutes copyright infringement, Media Consult Maier + Partner GmbH recommends consulting a lawyer beforehand.
14. Severability Clause
If any provision of this contract is or becomes invalid or unenforceable after the contract has been concluded, the validity of the remainder of the contract will not be affected. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that comes closest to the economic intent pursued by the parties with the invalid or unenforceable provision. The same applies in the event that the contract is found to have any gaps.
15. Jurisdiction
The exclusive place of jurisdiction is Karlsruhe.
